First Circuit Family Court in Kapolei

The First Circuit Family Court is based at the Kapolei Judiciary Complex. This is the court that handles every dissolution of marriage filed in Honolulu County. How Dissolution of Marriage Works in Hawaii

Hawaii is a no-fault state. Hawaii Revised Statutes Chapter 580 governs all dissolution of marriage proceedings. Under Section 580-41, the grounds include a marriage that is "irretrievably broken" or spouses who have lived apart for two or more years. You do not need to prove fault. You do not need your spouse's consent to file.

Under HRS Section 580-1, the Family Court in the circuit where at least one spouse is domiciled has exclusive jurisdiction over dissolution cases. For Kapolei residents, that is the First Circuit. You need to have lived in Hawaii for at least six months before you can file. There is no county-level residency requirement beyond that state rule. Military personnel stationed in Hawaii can meet the residency requirement based on their orders.
